Spirit Airlines, an airline based in the United States, ceased operations on May 2, 2026

Please read the following Closure Advisory in its entirety to ensure you understand the instructions that apply to your circumstances. Spirit Airlines has indicated that airfare purchased directly through them with a credit or debit card will be reimbursed automatically to the original form of payment. For airfare purchased through a travel agent, Spirit Airlines is asking customers to contact their travel agency for information about accessing a refund. If you purchased Spirit Airlines travel services through a TICO-registered travel agency or booking website, and do not receive a refund through Spirit Airlines or your travel agency, you may have an eligible claim through the Ontario Travel Industry Compensation Fund.

Airfare purchased directly from Spirit Airlines or through a travel agency/booking website located outside of Ontario is NOT eligible for reimbursement through the Compensation Fund.

Affected passengers should note the Compensation Fund does not reimburse consumers for the cost of replacement travel services purchased (e.g., if you buy new tickets on another airline, that new purchase isn’t reimbursed by the Fund).

Ontario Travel Industry Compensation Fund (Compensation Fund)

Consumers who purchased their Spirit Airlines travel services from a registered Ontario travel agency or booking website:

Consumers who purchased Spirit Airlines travel services from an Ontario registered travel agency or booking website and did not receive their travel services due to the closure of the airline, may file a Compensation Fund claim for reimbursement.

Please note that there is a legislated six-month filing deadline for claims on the Compensation Fund.

The filing deadline is November 3, 2026.

Claims received by TICO after the filing deadline date will not be valid.

Filing a claim against the Compensation Fund:

Ontario law requires claimants to explore all other possible options for reimbursement as part of the claims process, which may include filing a claim as part of the bankruptcy proceedings. TICO will share more information, as it becomes available.

Please complete the following steps prior to filing a claim against the Compensation Fund. 

Should you not be able to obtain all the required supporting documentation to substantiate your claim in a timely manner, please submit your claim to TICO with as much supporting information as possible prior to the filing deadline on November 3, 2026. Additional documentation can be submitted when it is obtained to avoid missing the deadline.

  1. Credit cards:
  • Where a refund has not been automatically applied by Spirit Airlines, all consumers who paid by credit or debit card and were charged by Spirit Airlines should contact their credit card company or financial institution to request a charge back (refund). 
  • If your credit card company or financial institution refuses to provide you with a refund, you will be required to obtain a letter from the credit card company stating that a credit refund will not be issued. 
  • The letter from the credit card company or financial institution must be submitted with your claim against the Compensation Fund.
  • If you are unable to obtain a refund (charge back) from your credit card company or financial institution or obtain all the documentation required to substantiate your claim in a timely manner, please submit your claim form to TICO prior to the deadline date.
  • Any additional documentation that is required to complete the claim can be sent to TICO when it is obtained.
  1. Travel Insurance:
  • Consumers who have travel insurance must make a claim with their insurance company.
  • If the claim is refused, you must provide written proof of refusal of the claim.
  • If you are unable to obtain a reimbursement from your travel insurance company or obtain all the documentation required to substantiate your claim in a timely manner, please submit your claim form to TICO prior to the deadline date.
  • Any additional documentation that is required to complete the claim can be sent to TICO when it is obtained.
